I don't know that it is illegal anywhere; it is a contractual agreement between authorized merchants and the manufacturer. Once it gets past the authorized dealers, I don't see how anyone can enforce the "not for resale" agreement.

On the other hand, one would think that enough buyers would complain after receiving "not for resale' items, that the seller wouldn't last long here. It's not illegal. The customers can do whatever they want, including sell them individually.

Is there are reason you're asking? Something that's happened? Or just that you noticed samples for sale on eBay and were concerned? My hubby has never worn any cologne fancier than Old Spice. This Christmas I bought him a lot of 15 or so samples on EBay- they made a terrific stocking stuffer and he gets to try out a whole bunch of different scents for a small investment! It's a win win for both seller and buyer! It is not a law, it is a contract between the manufacturer and the store.

Nothing on ebay about it. So the only problem I would see is if the company was a vero member and they objected for any reason. If I receive a sample size that is not advertised as "sample size" on the ebay listing, then I will leave bad feedback. I am tired of buying samples that I could have gotten myself for free. As far as I know, it's only the retailer that the manufacturer is trying to prevent from selling samples.

The manufacturers want to insure the public gets them free of charge, once the public has them though, they are free to do what they want with them - which includes selling them. That depends. I made the mistake of listing an iconic fragrance that's really cheap, undercutting everyone else.
